This discerning insight, which dates back more than 2000years to Aristotle, seems to have been ignored by most psycholo gists. For more than 40years theories of human action have assumed that cogni tion and action are merely two sides of the same coin. Approaches as different as S-O-R behaviorism, social learning theory, consistency theories, and expectancy value theories of motivation and decision making have one thing in common: they all assume that "thought (or any other type of cognition) can move any thing," that there is a direct path from cognition to behavior. In recent years, we have become more and more aware of the complexities in volved in the relationship between cognition and behavior. People do not always do what they intend to do. Aside from several nonpsychological factors capable of reducing cognition-behavior consistency, there seems to be a set of complex psychological mechanisms which intervene between action-related cognitions, such as beliefs, expectancies, values, and intentions, and the enactment of the be havior suggested by those cognitions. In our recent research we have focused on volitional mechanismus which presumably enhance cognition-behavior consistency by supporting the main tenance of activated intentions and prevent them from being pushed aside by competing action tendencies."

Die ihm fur die Erfullung seiner Aufgaben zustehenden Produktionsfaktoren (in erster Linie personelle und technische Mittel) versuchte er schon fruh erwerbswirtschaftlich zu nutzen, um die finanzielle Ausstattung zu verbessern. Die neben der Rundfunkgebuhr bedeutendste und sicherlich (gerade auch derzeit) heftig diskutierte Einnahmequelle, die Ausstrahlung von Horfunk- und Fernsehwerbespots zahlt zu diesen Tatigkeiten. Es seien aber auch beispielhaft Rechteverwertungen, Merchandising und die Vermietung von Senderstandorten genannt, die zu weiteren kommerziellen Ertragen bei einer offentlich-rechtlichen Rundfunkanstalt fuhren. Das BVerfG halt solche (fiskalischen) "Randnutzungen" fur so lange verfassungsgemass und von der Rundfunkfreiheit geschutzt, soweit sie in einem Kontext zu ihrer hoheitlichen Aufgabe stehen. Die europaische Integration fuhrt jedoch dazu, dass nun auch die Regeln im europaischen Kontext zu beachten sind. Trotz des EG-Protokolls uber den offentlich-rechtlichen Rundfunk in den Mitgliedsstaaten" hat das europaische Beihilferecht hier eine zentrale Bedeutung. Fur die Zulassigkeit von Randnutzungen spielt nun nicht mehr nur die verfassungsrechtliche wichtige Differenzierung zwischen dem Auftrag dienenden oder nicht dienenden Tatigkeiten eine Rolle. Eine weitere zentrale Bedeutung fur Zulassigkeit und Ausgestaltung der Tatigkeiten hat nun auch die im Beihilferecht wichtige Abgrenzung von kommerzieller und gemeinwirtschaftlicher Aktivitat. Der Saule des offentlich-rechtlichen Rundfunks kommt in diesem System der als Grundversorgung umschriebene Auftrag zu, umfassende und vielfaltige Programmangebote fur die Gesamtheit der Bevolkerung zu gewahrleisten. Das ist Grundvoraussetzung dafur, an die andere Saule des Systems, den privaten Rundfunk, geringere Programmanforderungen zu stellen, um dessen Refinanzierungsmoglichkeiten uber Markte offen zu halten. Durch den gleichberechtigten publizistischen Wettbewerb zwischen den Saulen, erhofft sich das BVerfG eine Belebung des inlandischen Gesamtangebots, die zu einer weiteren Starkung der Meinungsvielfalt fuhrt. Damit der offentlich-rechtliche Rundfunk seinen Aufgaben in diesem System gerecht werden kann, ist es Sache des Gesetzgebers fur ihn eine von Einflussen Dritter freie Organisationsform und entsprechende Finanzierungsmoglichkeiten zu schaffen. Der Gesetzgeber hat sich hier fur eine Mischfinanzierung aus einem uberwiegenden Anteil von Rundfunkgebuhren und anderen Finanzierungsmoglichkeiten, dabei ist insbesondere an die Werbung zu denken, entschieden. Im Rahmen dieser Arbeit soll ein Verstandnis fur die verfassungsrechtlichen Grundlagen der bestehenden Finanzordnung fur den offentlich-rechtlichen Rundfunk in Deutschland entwickelt werden.

Nach der Einfuhrung des werbefinanzierten Privatfernsehens und dem Start des Satellitenfernsehen spricht man in Zusammenhang mit dem digitalen Fernsehen auch von der dritten Fernsehrevolution." Die Digitalisierung ermoglicht eine hohere Anzahl an ubertragbaren Programmen, uber integrierte Ruckkanale konnen Sender und Zuschauer ohne Medienbruch kommunizieren und auch die Ausstrahlung in besserer Qualitat macht neue Formen des Fernsehkonsums wie z.B. Heimkino in Surround-Qualitat moglich. Die beschriebenen Moglichkeiten fuhren zu einer Ausdifferenzierung der Inhalte, das Fernsehen kann die Zuschauer individueller ansprechen. Die Inhalte die im digitalen Fernsehen angeboten werden hangen letztendlich von den okonomischen Aspekten dieser Ausdifferenzierung ab. Neben der Ausdifferenzierung der Inhalte kommt es aber auch zu einer Verlangerung der Wertschopfungskette im TV-Business mit ganz neuen Marktteilnehmern. Der vorliegende Text soll die Notwendigkeiten fur digitales Fernsehen deutlich machen und Moglichkeiten aufzeigen entlang der Wertschopfungskette Erlosptentiale zu finden. Geschaftsmodelle wichtiger Marktakteure werden charakterisiert und deren Erfolgsmoglichkeiten analysiert um so die Voraussetzungen eines erfolgreichen Agierens zu erkennen.

Mittlerweile haben die Rundfunkanstalten Controlling-Abteilungen in verschiedenen Auspragungen eingefuhrt. Aufgrund eines fehlenden Marktpreismechanismus bedarf es hierbei besonderer Herausforderungen fur das Controlling. In erster Linie, muss wie auch in den Rundfunkgesetzen der Lander festgeschrieben, Kostenwirksamkeit, d.h. eine interne Effizienz in der jeweiligen offentlich-rechtlichen Anstalt sicher gestellt werden. Hierbei wurden in jungster Vergangenheit auch modernere Instrumente, wie z.B. die Interne Leistungsverrechnung in vielen Rundfunkanstalten eingefuhrt. Die vorliegende Text soll helfen, ein Verstandnis fur das Controlling in offentlich-rechtlichen Rundfunkanstalten zu entwickeln und den Aufbau des Controllings in diesen Unternehmen zu verstehen.
